Saunders v Frittelli (DC)

We acted for the insurer of an insurance broker in this professional liability claim.  The negligent misstatement claim was based on alleged advice given in 2002/2003 on a trauma policy which was more than six years prior to the claim being filed in 2012. The claimants argued that the cause of action did not accrue until the insurer declined a claim arising from a kidney condition. The District Court accepted our argument that the cause of action accrued when the claimants took out the policy of insurance. The claim was struck out without it having to proceed to a costly trial.
