Body Corporate 351522 v Queenstown Lakes District Council (HC) 20.3.13

This was a procedural application in a professional liability claim.  Charlotta acted for the council.  The council’s expert advice was that the moisture issues the claimants’ apartments were experiencing might be caused by condensation as opposed to leaking.  To prove this theory the council needed access to the apartments.  The court allowed the council access to undertake testing.  The council also sought and was granted more detail of the claim made against it.  The council’s success meant it was able to fully understand the case made against it and mount a robust defence.
