Liu v Auckland Council (WHT)

This was a professional liability claim where we acted for the council.  The council admitted liability but went to hearing to argue about the scope of the repairs, the measure of loss, that the claimants had contributed to their own loss and that it was entitled to receive contributions from the other construction parties.  The council succeeded in all its arguments reducing the value of the claim from $415,206.80 to $147,704.50 (a saving of $267,502.30).  If all the construction parties paid their contributions the council’s share was just $44,311.35.
