Trustees Executors Ltd v Wellington City Council (WHT)

This was a professional liability claim brought by the owner of an alleged leaky building.  Frana acted for the council and its insurer.  The owner sought damages of over $1.1m against a number of parties.  The claims against all parties except the council were time barred.  The council was the only party that had undertaken acts within time, but was found not to have been negligent.  The council escaped liability for the claim.
