Lee v Ryang (HC)

This was an appeal by a project manager from a determination of the Weathertight Homes Tribunal.  It was a professional liability claim. Frana acted for the council who wanted to preserve the Tribunal’s findings on the project manager’s duty of care and contribution. The High Court found that the project manager owed a non delegable duty of care and dismissed his appeal. The council also preserved on an appeal the project manager’s contribution of 80% of the judgment sum. This case is a useful precedent for asserting project managers owe non delegable duties of care in certain circumstances.
