Scandle v Far North District Council (CA)

This was a professional liability claim brought by the owner of a house that was moving down a cliff top property.  The council had deemed the house unsafe and prevented the owner from occupying the house.  Susan and Frana acted for the insurer of the council.  The Court of Appeal agreed with the findings of the High Court and the council escaped liability and was awarded costs. This case is one of the leading precedents in this country on causation.
